1. Acceptance of Terms

By accessing and using the services provided by EVERYTHINK DEV CO. LTD ("Company", "we", "us", or "our"), you ("Customer", "you", or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services Description

EVERYTHINK DEV CO. LTD provides the following services:

  • Co-location Services: Data center facilities, power, cooling, and physical security
  • Private Cloud Solutions: Dedicated cloud infrastructure and virtualization services
  • Network Consulting: Network design, optimization, and management services
  • HPC Implementation: High-performance computing and supercomputer solutions
  • AI Factory & GPU Farm: AI/ML infrastructure and GPU computing resources
  • System Integration: IT system integration and technical support services

3. Service Level Agreement (SLA)

3.1 Uptime Guarantee

We guarantee 99.9% uptime for our co-location and cloud services, excluding scheduled maintenance periods.

3.2 Maintenance Windows

Scheduled maintenance will be performed during designated maintenance windows with at least 48 hours advance notice.

3.3 Support Response Time

  • Critical issues: Response within 1 hour
  • High priority issues: Response within 4 hours
  • Normal issues: Response within 24 hours

4. Customer Responsibilities

  • Maintain accurate account information and contact details
  • Comply with all applicable laws and regulations
  • Use services only for lawful purposes
  • Protect account credentials and access information
  • Report security incidents or suspicious activities promptly
  • Backup data regularly and maintain disaster recovery plans

5. Payment Terms

5.1 Billing

Services are billed monthly in advance unless otherwise specified in your service agreement.

5.2 Payment Due Date

Payment is due within 30 days of invoice date.

5.3 Late Payment

Late payments may result in service suspension and additional charges of 1.5% per month on overdue amounts.

5.4 Taxes

All prices are exclusive of applicable taxes, which will be added to invoices as required by law.

6. Data Security and Privacy

We implement industry-standard security measures to protect your data and maintain confidentiality. Our detailed privacy practices are outlined in our Privacy Policy.

Data Protection: We comply with applicable data protection laws including Thailand's Personal Data Protection Act (PDPA) and international standards.

7. Limitation of Liability

To the maximum extent permitted by law, EVERYTHINK DEV CO. LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

8. Termination

8.1 Termination by Customer

Customers may terminate services with 30 days written notice.

8.2 Termination by Company

We may terminate services immediately for breach of terms, non-payment, or illegal activities.

8.3 Data Retrieval

Upon termination, customers have 30 days to retrieve their data before permanent deletion.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand. Any disputes shall be resolved in the courts of Bangkok, Thailand.
